TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the websites and AI media API platform provided by SEEK AONVAST LTD, trading as PureApi ("Company," "we," "us," or "our"). By creating an account, purchasing credits, creating an API key, or using our services, you agree to these Terms. These Terms form a binding contract between Company and you ("Customer," "you," or "your"). Company registration details are provided in Section 19.
BY USING OUR SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.
We may update these Terms. The "Last Updated" date above indicates when these Terms were last changed. We may notify you of material changes by email or through the Services. Unless we state otherwise, updated Terms take effect when posted. Your continued use after notice constitutes acceptance.
1. Services
PureApi provides a unified AI image and video generation platform at https://pureapi.org/ (the "Site"), including a developer console, model documentation, and programmatic REST APIs (collectively, the "Services").
Through the Services, you may obtain API keys, purchase credits, submit generation requests to third-party AI models, and retrieve asynchronous task results. Model availability, credit pricing, request parameters, and response formats are described in our documentation and pricing pages and may change from time to time.
Subject to your compliance with these Terms and payment of applicable fees, Company grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your personal or internal business purposes, in accordance with our Documentation.
If you integrate the Services into your own product or service made available to your end users ("Customer Solution"), your use is also governed by our API Services Supplemental Terms at https://pureapi.org/legal/api-services.
2. Defined Terms
"Customer Input" means information, data, text, prompts, media, URLs, and other content you submit through the Services.
"Output Content" means images, videos, audio, or other content generated by the Services based on Customer Input.
"Documentation" means API reference materials, model pages, FAQs, and other instructional materials we publish on the Site.
"End Users" means your end-user customers who use your Customer Solution.
"Term" means the period during which you maintain an account and are permitted to use the Services.
"Usage Data" means anonymized or aggregated data derived from use of the Services, which does not identify you or include your Customer Input in identifiable form.
3. Eligibility
You must be at least 18 years old (or the age of legal majority where you live) to use the Services. If you are a parent or guardian and believe a minor is using the Services without consent, contact us using the contact details in our Terms of Service, Section 19 (https://pureapi.org/legal/terms-of-service).
If you operate a Customer Solution, you are responsible for ensuring your End Users meet these eligibility requirements.
4. Accounts and API Keys
You must create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and API keys. API key plaintext is shown only once at creation or reset. You must not share API keys publicly or embed them in client-side code exposed to End Users.
You must notify us promptly if you suspect unauthorized access to your account or API keys. We may suspend or revoke API keys or accounts for security, legal, or policy reasons.
If you administer a team or organization account, you are responsible for your team members' compliance with these Terms and our Acceptable Use Policy.
5. Customer Input, Output Content, and Data Use
You retain ownership of your Customer Input. You grant Company a non-exclusive, royalty-free license to use, store, process, transmit, and display Customer Input solely to provide, secure, maintain, and improve the Services, comply with law, and enforce these Terms.
Subject to your compliance with these Terms, as between you and Company, you own Output Content generated for you through the Services, to the extent permitted by applicable law and third-party model terms.
Company will NOT use your Customer Input to train, develop, or improve Company's own AI models or machine learning systems. Customer Input is processed only to fulfill your requests and for necessary operational purposes such as billing, logging, fraud prevention, safety review, and support. Content may be transmitted to third-party model providers to perform generation; see our Privacy Policy at https://pureapi.org/legal/privacy-policy.
Company may generate, collect, and use Usage Data for analytics, service improvement, security, and lawful business purposes. Company owns Usage Data.
You represent that you have all rights necessary to provide Customer Input and to use Output Content as intended. You are solely responsible for your Customer Input and your use of Output Content.
6. Acceptable Use
Your use of the Services is governed by our Acceptable Use Policy at https://pureapi.org/legal/acceptable-use-policy, incorporated by reference. Violations may result in suspension or termination.
7. Restrictions
Except as expressly permitted, you will not:
(a) reverse engineer, decompile, or attempt to derive source code from the Services;
(b) resell, sublicense, or expose PureApi API keys or raw API endpoints directly to End Users (integration must be through your Customer Solution as described in our API Services Terms);
(c) scrape, crawl, or systematically extract data from the Services;
(d) circumvent security, rate limits, or safety controls;
(e) use the Services to build a competing API platform using our Services as a backend;
(f) introduce malware or interfere with the operation of the Services;
(g) use the Services in violation of applicable law or third-party model provider terms;
(h) generate, request, or distribute pornographic, sexually explicit, or NSFW content through the Services.
We may limit API calls that we reasonably determine are excessive, abusive, or harmful to the Services.
8. AI Features Disclaimer
The Services use probabilistic AI models. Output Content may be inaccurate, incomplete, offensive, or similar to content generated for other users. Company does not warrant that Output Content is original, non-infringing, or suitable for any particular purpose. You use Output Content at your own risk.
9. Fees, Credits, and Payment
Services are billed using prepaid credits. Each API request or other use deducts credits according to the pricing shown on the Site or in Documentation at the time of use.
Credits purchased through the Site expire 365 days from the date of purchase.
Once purchased, credits may be used only to consume the Services. Credits are non-refundable, non-transferable, and cannot be exchanged for cash, except where required by applicable law or expressly agreed by Company in writing.
Prices are shown exclusive of applicable taxes. You are responsible for taxes arising from your purchases, excluding taxes based on Company's income.
Payments are processed by third-party payment providers such as Stripe. We do not store full payment card details on our servers.
For asynchronous API tasks, credits may be frozen at submission, charged upon successful completion, and restored to your balance upon failure, cancellation, or validation error, as described in our Documentation. Credits consumed for completed requests are not refundable.
10. Third-Party Services
The Services rely on third-party infrastructure and AI model providers ("Third-Party Providers"). We are not responsible for Third-Party Provider outages, policy changes, or actions. Your use may be subject to additional third-party terms. We may identify relevant Third-Party Providers in our Documentation.
11. Suspension and Termination
We may suspend or terminate your access if you breach these Terms, our Acceptable Use Policy, or applicable law; if payment is overdue; if your use threatens the security or integrity of the Services; or if required by law. We will use reasonable efforts to notify you before suspension where practicable.
You may close your account using the contact details in our Terms of Service, Section 19 (https://pureapi.org/legal/terms-of-service). Upon termination, your right to use the Services ends. Provisions that by nature should survive will survive, including Sections 5, 11–16.
12. Intellectual Property
Company owns the Services, Documentation, software, branding, and all related intellectual property, except for your Customer Input and your Output Content as described above. You may not use Company trademarks without prior written consent.
13. Feedback
If you provide suggestions or feedback, we may use it without restriction or compensation to you.
14. Indemnification
To the fullest extent permitted by law, you will indemnify and hold harmless Company and its officers, directors, employees, and agents from claims arising out of: (a) your Customer Input or Output Content; (b) your breach of these Terms; (c) your Customer Solution or End Users; or (d) your violation of law or third-party rights.
15. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. COMPANY DOES NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL.
COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) £50 OR (B) THE AMOUNTS YOU PAID TO COMPANY FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that Company may seek injunctive relief in any court of competent jurisdiction.
If you are a consumer resident in the United Kingdom, you may also have mandatory statutory rights under the Consumer Rights Act 2015 and other applicable laws, which nothing in these Terms affects.
18. General
These Terms, together with the Acceptable Use Policy, Privacy Policy, and API Services Terms (if applicable), constitute the entire agreement between you and Company. You may not assign these Terms without our consent. Company may assign these Terms. Failure to enforce any provision is not a waiver.
